These General Terms and Conditions apply to the purchase of products in the e-shop of DYNAMIC MOUNTAIN ROCK GmbH and to all information, documents, graphics, films, music and/or all other services provided in the e-shop or by DYNAMIC MOUNTAIN ROCK GmbH. The shown drawings, illustrations, pictures, sample collections, data, technical data, weight, dimension and performance descriptions are non-binding and deviations from the end product may occur. Prices and products are subject to change without notice. Conclusion of contract and withdrawal
By presenting our goods, you are invited to submit a purchase offer in the form of an order. If we accept your offer or order, you will usually receive an e-mail confirmation within one hour. Of course, we will also inform you by e-mail if we are not able to accept your order. If the goods are not available despite the acceptance of your order, we have the right to withdraw from the contract. In this case we commit ourselves to inform you immediately about the unavailability of the ordered goods and will refund the purchase price immediately in the case of the already occurred debit of your credit card or your PayPal account. Order quantities must correspond to normal household quantities. Delivery and shipping costs
The delivery takes place to the delivery address indicated by the customer. For the delivery the indication of a valid telephone number which is attainable during the day is compelling to indicate. If the recipient is not at home and cannot be reached due to an invalid telephone number, we refrain from charging the costs incurred for a new delivery.
Please note that all information about delivery times and prices are without obligation for DYNAMIC MOUNTAIN ROCK GmbH. The availability of the goods refers to the multi-warehouse of DYNAMIC MOUNTAIN ROCK GmbH, which consists of the warehouse Germany. Should it happen that an ordered item is no longer available in the warehouse intended for delivery, delivery may be delayed by a few days. The country-specific value added tax is included in the sales prices and is shown before order completion. Payment and retention of title Payment can be made by credit card at MasterCard and Visa via SIX Payment Services Switzerland or via PayPal. This may result in additional costs for interbank foreign commissions of 1% to 2% of the order volume. These additional costs will be charged directly to the customer. The goods remain our property until full payment has been received and will not be dispatched.
You can return the received goods within 10 days by returning the goods. The return costs are to be borne by the customer. If the return is not carried out according to our instructions and the goods are returned incorrectly, we reserve the right to charge the additional costs incurred to the sender/customer. The timely dispatch of the goods (postmark) is sufficient to meet the return deadline. If you make use of your right of return, the purchase contract becomes invalid upon arrival of the goods at DYNAMIC MOUNTAIN ROCK GmbH. Warranty and liability For all products that can be purchased at DYNAMIC MOUNTAIN ROCK GmbH, the warranty period is 12 months from the day the goods leave our premises. In warranty cases, the products must be submitted directly to DYNAMIC MOUNTAIN ROCK GmbH. The costs for returns are at the expense of the customer. The warranty extends to all defects occurring within the agreed warranty period, provided these are demonstrably caused by bad material or faulty manufacture. Liability shall, however, be limited, at the option of the guarantor, to repair, replacement or remuneration of the invoice value of the defective goods. Further claims of the buyer are excluded. In particular, DYNAMIC MOUNTAIN ROCK GmbH shall not be liable for damage caused by improper use or natural wear and tear or for damage not caused to the delivery item itself (consequential damage). Modifications or repair work carried out without our written consent or that of the manufacturer, as well as non-compliance with the General Terms and Conditions of Business, shall void the warranty obligation.
If you send any ideas, comments, questions, data, graphics or the like to DYNAMIC MOUNTAIN ROCK GmbH, they become the exclusive property of DYNAMIC MOUNTAIN ROCK GmbH. The contributions will be considered non-confidential and we will use or publish them in any way without obligation or notice to you. The Contributions or any other type of information you send to us shall not be or consist of any material that is offensive, pornographic, defamatory, blasphemous, unlawful or in violation of any applicable law, whether civil, criminal or religious. You acknowledge that everything you submit is your property and you have not copied it, in whole or in part, from any third party. Please do not send us anything that needs to be kept confidential. All personal data will be treated confidentially. The data required for business transactions will be stored and only passed on to affiliated companies within the framework of order processing.
Applicable law and place of jurisdiction
All contracts are exclusively subject to Swiss law. The place of jurisdiction is Zurich.
